The stay prayer ended with the application itself

The Mohamedali ruling rejected a stay request framed only until the application was determined, without deciding the compensation appeal's merits.

The applicant wanted protection from enforcement while challenging a land-compensation decision. But the substantive prayer asked for a stay only until the application itself was determined, not until the intended appeal was heard.

That wording decided Cabinet Secretary Ministry of Defence v Mohamedali [2024] KECA 367 (KLR), Civil Application E095 of 2023, before the Court of Appeal on 12 April 2024.

The court dismissed the motion as incompetent with costs to the respondent. It did not decide whether the intended compensation appeal should succeed.

A significant underlying dispute, but a narrow application

The background concerned challenged compulsory acquisition of land used for a naval facility in Mombasa, disputed historical compensation and monetary relief granted by the ELC.

The Court of Appeal described the record before it as scanty. In particular, the underlying petition and supporting affidavit were not included.

This matters to the scope of any explanation. The ruling's account of the compensation dispute should not be presented as a fresh appellate confirmation of the claimant's title, the proper acquisition date or the amount lawfully payable.

The court was considering the motion actually brought before it, on the limited record supplied.

The duration of the prayer was decisive

The motion sought a stay pending hearing and determination of the application.

That form of protection can have a different duration from a stay pending an appeal. Once the application is decided, protection expressed to last only until that event no longer provides the continuing relief the applicant appeared to want.

Paragraphs 7–9 and 14 identify the actual prayer. The court could not simply treat it as a differently framed request extending through the intended appeal.

The distinction was not about an obscure valuation point or a competing interpretation of the acquisition evidence. It was about the event at which the requested protection ended.

The ordinary interim tests were not reached

Because of the way the prayer was framed, the court did not proceed to the usual assessment of arguability and whether an appeal would be rendered nugatory without a stay.

It is therefore inaccurate to report that the court found the compensation appeal unarguable or decided that the applicant could never suffer relevant prejudice.

Those questions were not the basis of this dismissal.

Equally, the ruling did not turn the trial compensation award into an appellate merits judgment. A refusal of interim relief can leave an underlying order unaffected without deciding that order's substantive correctness.

What the final order did and did not do

The motion was dismissed as incompetent, with costs to Mohamedali.

The ruling did not dismiss the intended appeal itself. It also did not establish that compensation was paid, that the underlying decree was satisfied or that the disputed land had reached an uncontested final ownership position.

The source contains conflicting historical dates and property descriptions. Those inconsistencies are not silently resolved here, particularly given the court's own description of the limited record.

The retained evidence supports the procedural holding, not a reconstructed account of all the earlier acquisition events.

Questions before relying on a stay request

  • Until what event does the actual prayer seek protection?
  • Is the request interim to another application or intended to last through an appeal?
  • Does the court have the documents needed to understand the underlying order?
  • Did the ruling decide the merits tests or dispose of the application on a different basis?

A Kenyan advocate should examine the precise motion and resulting order. A document described generally as a stay application does not necessarily seek, or obtain, the protection a party assumes.

The same distinction matters when reviewing a property or compensation file from outside the litigation. The application, the order made on it and the substantive appeal are separate records.

Screening can organise the order's scope

ArdhiScore screening can help organise available source-linked information, dates and questions for professional enquiry. It cannot correct a prayer, obtain automatic stays or deadline protection, guarantee compensation, certify title or boundaries, or replace an official search and Kenyan legal advice.

This is historical analysis, not legal advice or current enforcement status. Earlier named-reader research dated 11 September 2026 identified no later primary decision in this dispute. Neither the underlying ELC judgment nor a later merits appeal was independently read in that source pass.

Primary decision

Read the ruling. See paragraphs 1–6 for the limited background, 7–9 and 14 for the prayer, and 15–16 for the court's reasoning, dismissal and costs.

Retained-source limitation: Local review covered the judicial header and paragraphs 1–16, including paragraph 12 omitted by simplified extraction. That paragraph records counsel's filing objection, not a holding. The signed closing and body date were not retained, so this draft remains held despite the supported procedural outcome.
