Conveyancing is the formal legal process through which ownership of land is transferred from one party to another. In Kenya, this process must be handled by a qualified advocate and involves preparing sale agreements, conducting searches, paying stamp duty, and registering the transfer at the Land Registry.
Typical Steps
- Negotiation and agreement on terms
- Due diligence and official search
- Preparation and signing of the sale agreement
- Payment of the purchase price (often through an advocate's escrow account)
- Payment of stamp duty and other government fees
- Execution and registration of the transfer documents
- Issuance of a new title deed in the buyer's name
