An allegation that a new adjudication section overlaps an earlier area can raise serious questions without automatically stopping the process. In Saire v Land Adjudication Officer, the Court of Appeal found an arguable intended appeal but declined the injunction and stay requested. The ruling did not finally determine the alleged overlap or award ownership to either side.

- Case: Saire & 2 others v Land Adjudication Officer, Transmara West & 15 others
- Court: Court of Appeal at Nakuru
- Recorded decision date: 20 April 2023
- Citation: Civil Application E003 of 2022; [2023] KECA 460 (KLR)
- Stage: Interlocutory application for injunction and stay pending an intended appeal.
- Primary decision: Read the ruling.
The alleged overlap was contested
The applicants challenged the Kimintet E adjudication section and committee, also spelled Kimitent in the source. They alleged overlap with an earlier adjudication area and risk to settled community members. Their request sought temporary protection while the appellate challenge was pursued. (Paragraphs 1-6.)
The respondents disputed that account. They relied on committees specific to the relevant sections and the statutory mechanisms for raising objections. Those were competing positions, not an agreed map of the area or a final determination of which committee had acted unlawfully. (Paragraphs 7-12.)
The distinction matters when a community, buyer or lender receives a summary saying that a section has been challenged. A challenge identifies an issue requiring examination. It does not, by itself, establish that an overlap exists or that every allocation in the area is invalid.
The application did not resolve every procedural question
The validity of the notice of appeal was disputed. The Court of Appeal declined to determine that question within this application. It nevertheless found an arguable intended appeal for the purpose of considering the interim relief sought. (Paragraphs 17-24.)
An arguable appeal is not a promise that the appeal will succeed. Equally, leaving a notice issue unresolved is not a certificate that every procedural requirement has been satisfied.
This account does not convert the ruling into advice that filing a particular document automatically preserves a deadline or secures a stay. The effect of a filing and the relief granted by a court need to be assessed separately.
The second requirement was not established
The court was not persuaded that the applicants had demonstrated irreversible loss making a successful appeal ineffective without the requested restraint. It also considered the prejudice that would follow from stopping the adjudication and judicial-review processes. The application therefore failed on the nugatory aspect. (Paragraphs 25-26.)
That reasoning does not establish that the applicants' substantive concerns were false. It explains why the court did not consider the requested temporary intervention justified on the material presented.
References to possible damages in an interim assessment are not damages awards. The ruling did not quantify compensation or direct payment to the applicants.
The exact result
The motion for an injunction and stay of judicial-review proceedings was dismissed. Costs were ordered to be in the appeal. The court made no final ownership determination or adjudication-overlap finding. (Paragraph 26.)
The ruling therefore should not be presented as either a completed victory for the challenged adjudication or a successful challenge that froze it. It was a refusal of the particular interim relief requested.
The retained material does not establish the eventual outcome of the underlying judicial review or any substantive appeal. Nor does it show that the relevant boundaries, allocations or objections were later resolved.
The opening paragraph runs some applicant names together. The retained header distinguishes three intended appellants, but its appellate-provenance parenthesis cuts off. This article avoids unnecessary personal identifiers and does not reconstruct a map from textual variations.
Questions when adjudication sections are disputed
Which notices define the sections and committee mandates? What evidence demonstrates the alleged overlap? Which objection or review process has actually been invoked, and what does the latest court order permit or restrain?
A qualified advocate should examine those records with appropriate official mapping and adjudication material. The existence of an arguable appeal should not be treated as a substitute for that work.
Local AI review on 11 September 2026 read paragraphs 1-26. The header is incomplete and no dated closing is retained; the recorded date is not body-verified and full-primary review remains held. No new acquisition or history search occurred. Absence of a located later decision does not establish finality.
